A release deed should be obtained from your brother in law to avail a loan by making your husband as co-applicant or make your brother in law as third applicant in the home loan application.

Banks will disburse the loan in two parts in which a Pay Order will be prepared for the outstanding loan amount of the loan and the remaining for the balance sale consideration. First the payorder for the other bank will be realesed and once the documents are recieved by the vendor from the bank and at the time of registration the second payorder will be issued. So it is quite safe to buy a property which is already mortgaged in bank due to loan.

The property should be registered as per the agreement. If the agreement reflects your mother name then you can register the property on her name if not it is not possible n bank will not accept it. By registering a property on ladies name one can get a maximum of 1% concession on stamp duty.

One need to be more careful when buying a property from a co-operative society as the societies hold a large parts of lands on their name and you will be buying a small piece of that. If the customer does not start the construction then bank may convert that loan into plot loan with a maximum fine of 4% on the loan amount and with the higher rate of interest or banks may ask to close the loan.
